When all conditions of a contract have been met, the contract goes ‘unconditional’, which indicates that the property has been sold and awaiting the settlement day for changeover of possession of the home.
Your settlement date will be indicated on your contract of purchase, otherwise, speak to your solicitor about the date.
On or before settlement date you are entitled to a pre-settlement inspection, to make sure that the property is in as good as condition as to when it was marketed. You should also double check that all the inclusions listed on the contract are present.
One thing to take note is that in QLD sellers are not legally bound to have the property professionally cleaned prior to settlement, so it may be wise to organise a cleaner for the day after settlement, if you are not intending to move in straight away.
Upon settlement, your solicitor will call you to advise that settlement has gone through. The real estate agent is not authorised to hand out keys until they have received a fax from both the buyers and sellers solicitor indicating that settlement has occurred.
