So you have signed a contract, one the most common questions from buyers is “do I have to nominate a solicitor”?
Although not compulsory it is recommended that you nominate a solicitor or legal body to act on your behalf for the transaction of sale. Once you have appointed a solicitor the original contract of sale will be forwarded to the solicitor so they can act on your behalf.
What does a solicitor do from here?
- Your solicitor is there to handle all the legal aspects of your sale (i.e. the transfer of the title / ownership of the property).
- They will conduct all relevant property searches (i.e. title search – to ensure the property is unencumbered by easements etc).
- They will monitor all contract conditions for example finance approval or any special conditions on the contract.
- They will ensure that any disputes between you the buyers and the sellers are avoided or resolved in a timely fashion.
- They will also negotiate any extra contract terms on behalf of the buyer or seller if necessary.
