A ‘Sustainability Declaration’ is a compulsory checklist that must be completed by the seller or a delegate when selling a residential property in Queensland. It will be required prior to marketing a property for sale, and the property will not be permitted to be advertised for sale until it is completed, effective 1 January 2010.
The checklist will identify the property’s sustainability features in four key areas:
- Energy
- Water
- Safety
- Access
The declaration will be designed to be completed by the property owner. It is also possible for the property owner to nominate a third party representative such as a guardian or suitably qualified person such as a building surveyor, builder, architect or building designer.

Legislative amendments to the sustainable housing policy were introduced to State Parliament on Thursday 29 October 2009.The Bill seeks to formalise the implementation of the sustainability declaration in an attempt to raise awareness and drive housing markets to reflect the true value of sustainable housing features, and therefore requires amendments in both the Building Code of Australia (BCA) and Property Agents and Motor Dealers Act 2000 (PAMDA) (Source: REIQ).
